To assist our clients and other members of the electric industry in complying with the North American Electric Reliability Corporation (NERC) reliability standards and avoiding reliability-related penalties, White & Case has created a NERC Database that contains summaries of NERC Notices of Penalty (NOP), Administrative Citation of Penalties (ACP) and Find, Fix and Track (FFT) Reports.

The White & Case NERC Database facilitates compliance by streamlining the enforcement actions taken by NERC and the eight regional entities in an easy-to-use format. Our comprehensive summaries, which are organized by NERC reliability standard, focus on the specific facts that were identified by NERC as important to resolving the violation. In addition, each summary is linked to the applicable publicly available NOP, ACP or FFT filed by NERC and the related FERC order.

White & Case's energy lawyers have been actively counseling clients on reliability issues since NERC was certified in 2006 by FERC as the Electric Reliability Organization in the United States, pursuant to Section 215 of the Federal Power Act. We have advised owners, operators and users of the bulk power system, as well as upstream owners of project companies, on NERC registration requirements, audits, self-reports, methods for complying with certain reliability standards, developing compliance protocols and procedures, assessing and mitigating reliability related risk when purchasing and selling jurisdictional assets and negotiations with NERC and regional entities.
