Overview

Alexandre Kiabski is a Partner in the Commercial Litigation practice of White & Case in Paris.

Alexandre specializes in commercial disputes, including civil, commercial, and securities disputes. He advises and represents large French and international groups in complex and high-stakes cross-border disputes (particularly post-acquisition disputes, shareholder disputes, or antitrust litigation), as well as in class actions, across a wide range of industries including new technologies, manufacturing and industrial and financial services. He also participates in mediations and conciliations.

He holds degrees from the Aix-en-Provence Law School, King's College London, and Sciences Po.

Experience

Litigation*

  • Representing an American investment management firm before the Court of Appeal of Paris and French Supreme Court following a decision of the Autorité des Marchés Financiers (AMF) ordering the firm to pay a record €20 million fine for alleged violations of stock market regulations and obstruction to the AMF's investigation;
  • Representing a large, global technology company in the context of the first-class action in France relating to data protection and alleged breaches of the GDPR;
  • Representing major international hotel groups in the context of commercial proceedings before French courts relating to the ownership and management of hotels and restaurants located in Paris;
  • Acting for various large industrial groups in the energy sector (gas, oil) in the context of commercial disputes with significant financial and reputational stakes;
  • Acting for large French media and insurance companies in the context of unfair competition proceedings;
  • Acting for the shareholders of start-up companies and large industrial groups in the context of corporate disputes against other shareholders (unfair competition, fraud, wilful misrepresentation);
  • Acting for major US film production and distribution companies in the context of proceedings before French courts relating to allegations of copyright infringement;
  • Representing leading companies in the adult websites industry in the context of proceedings before the Judicial Court of Paris and the French Administrative and Civil Supreme Courts, following attempts by the Conseil Supérieur de l'Audiovisuel to enforce legislation imposing age verification obligations;
  • Acting for one of the largest French banking groups regarding a dispute between entities of the group concerning regulatory issues;
  • Representing several subsidiaries and former managers of one of the leading mining conglomerates before the Court of Appeal of Dakar and Supreme Court of Senegal, in the context of a $500 million dispute with a South African competitor which initiated criminal and civil proceedings related to alleged acts of bribery;
  • Representing one of the foremost mining companies in a multi-billion cross-border matter involving criminal, regulatory and commercial issues in the Democratic Republic of Congo;
  • Advising an African state in the context of cross-border enforcement proceedings in several European (Luxembourg, France, Monaco) and Asian (Hong Kong) jurisdictions; and
  • Advising a company in the context of commercial disputes with the State of Djibouti.

Arbitration*

  • Acting for an African State in the context of ICSID arbitration proceedings with high financial stakes (approx. €1 billion) raising complex issues of environmental, mining, property and investment law, brought by a French investor under a bilateral investment treaty;
  • Representing an African State in the context of ad hoc arbitration proceedings initiated by a leading French logistics and transportation group in relation to alleged contractual breaches of a harbour concession;
  • Acting for an African State in a €600 million ICC arbitration initiated by a foreign contractor handling various infrastructure projects and related criminal proceedings in various jurisdictions (Switzerland, France) for allegations of bribery and money laundering;
  • Representing one of the Big Four accounting and audit firms in UNCITRAL arbitration proceedings with significant reputational stakes, initiated by a counterparty for breach of contract;
  • Representing an oil company in the context of a contractual dispute with a partner in connection with a project in the Middle East.

  • Lecturer in Commercial Law, University of Versailles Saint-Quentin (Versailles) in 2020-2024.

Pro bono experience

  • Pro bono attorney for French NGO "Collectif des Parties Civiles pour le Rwanda" in the context of a number of ongoing criminal investigations and proceedings against alleged perpetrators of the Tutsi genocide, from 2012 to date.
