Overview

Will is a senior associate in White & Case's Dispute Resolution group based in London. He advises clients involved in high-value, complex and cross-border commercial disputes before the English courts, international arbitrations (including under the ICC, LCIA and SIAC rules) and criminal and regulatory investigations. He is a Solicitor-Advocate and holds a Higher Rights qualification.

Will has a broad commercial practice and acts predominantly for sovereign states and multinational corporations. He has considerable experience in advising clients on commercial disputes involving fraud, asset tracing, white-collar investigations, setting aside arbitral awards, obtaining and defending freezing injunctions, warranty and indemnity claims and shareholder disputes. Many of his cases involve parallel criminal and regulatory investigations. He has also litigated multiple insurance claims for both insurers and policyholders.

Experience

Município de Mariana v. BHP, Technology and Construction Court, ongoing. Acting for the Part 20 Defendant in a group action concerning the collapse of a Brazilian dam where over 730,000 claimants are seeking damages of around £36 billion.

Process & Industrial Developments v Federal Republic of Nigeria, Commercial Court, 2019-20. Successful representation of Nigeria in set-aside proceedings relating to a US$10bn arbitral award allegedly procured by fraud. Related enforcement proceedings in the USA and regulatory / criminal proceedings in Nigeria.

ICC and SCIA Arbitrations, 2020-22. Successful representation of an African state in a series of arbitrations under the ICC and SCIA rules involving public procurement corruption affecting assets in excess of US$2.1 billion. Related criminal, regulatory and civil proceedings on three continents.

ICC Arbitration, ongoing. Acting for a multinational corporation in the steel industry in a dispute concerning the interpretation of a long-term supply contract.

SEC/DOJ investigation, ongoing. Acting for a US-listed company in relation to parallel SEC / DOJ investigations regarding securities fraud allegations.

Paul Andrew Whittaker v Bertha UK Limited, Business & Property Courts, 2021-23. Successful representation of Bertha UK in a shareholder dispute over Dogwoof Limited, a well-known documentary film production company, in defence of a claim for specific performance of the obligatory transfer provisions of a Shareholders Agreement and damages.

ICC Arbitration, 2021-2022. Acting for two Chinese state owned enterprises in a dispute regarding a $30m indemnity claim under a SPA.
