
White & Case secures victory on behalf of Snap Inc. in US Federal Circuit Patent dispute

Global law firm White & Case LLP has secured a significant victory on behalf of Snap Inc. in the US Court of Appeals for the Federal Circuit. Finding for Snap, the Federal Circuit affirmed a final written decision from the US Patent & Trademark Office finding invalid a patent asserted by Xerox Corp. against a trio of social media companies—including Snap—directed to use of AI-based data analysis on mobile devices.
In her decision, Chief Judge Kimberly Moore rejected an appeal from Xerox and stated that "substantial evidence" supports a 2023 Patent Trial and Appeal Board decision that invalidated all claims of Xerox's US Patent No. 9,208,439, which covered a system for receiving and analyzing information to provide contextual intelligence-based recommendations to mobile device users.
Chief Judge Moore affirmed the PTAB's ruling and rejected Xerox's argument that the Board ruled incorrectly when it sided with Snap's challenge to all 20 of the patent claims.
