In an article for Gas International, White & Case partner David Strickland and counsel Chris Duncan look at the best ways to overcome procurement challenges when working on major projects.
Strickland and Duncan write: "One of the biggest challenges is ensuring the owner maintains control of the procurement process, thus allowing the owner to drive the timeline and ensuring that they enter into contracts of the best available terms. This is particularly important in the context of limited or non-recourse project financed plant, given that the lenders will require that a significant level of risk and liability is passed away from the owner/borrower and to the contractors under the relevant contracts."
