The American Lawyer's Litigation Daily recognized a team White & Case for securing a reversal from the Ninth Circuit in a case concerning when federal contractors can remove cases to federal court under the federal officer removal statute.
In a 2-1 decision, the court held that the Firm's clients—private contractors who provided war-zone security services to the U.S. Department of Defense under the Theater-Wide Internal Security Services II (TWISS II) contract—had met their burden to show federal jurisdiction over claims brought by a group of their employees who guarded bases, equipment and personnel in Iraq.
White & Case team was led by partner Tara Lee, counsel Scott Lerner, who argued the appeal, and associate Benedict Bernstein.
