In Commercial Dispute Resolution, White & Case partners David Hille and Glenn Kurtz, global co-chairs of commercial litigation, commented on the litigation trends they believe will emerge in 2025, including data breach and cybersecurity cases, disputes between suppliers and manufacturers, cryptocurrency and state courts competing with Delaware for corporate disputes.
On data and cybersecurity cases, they said, "This is quickly moving from a tech company-specific practice area to an every-company area because, at this point, every company is a tech company at some level and is handling data."
Commenting on the uptick in disputes between suppliers and manufacturers, Hille noted, "These disputes pose interesting issues because these are, oftentimes, companies that are both competitors and collaborators with long-term relationships. Navigating those types of disputes is an interesting skillset that you have to develop in order to fight the case."
Kurtz also said he expected a focus on cryptocurrency in the new year. "The new incoming administration seems to be more focused on cryptocurrency, and when you have more focus, you typically end up with more litigation. [In addition], AI is still in its infancy and so maybe 2025 won't be the year, but it’s going to be a pretty big focal point at some point for litigators."
