
In Law360, White & Case Commercial Litigation partner Raoul Cantero is quoted on a recent victory in the United States District Court for the Southern District of Florida, dismissing a petition to confirm a US$135 million arbitration award based on a cross-border dispute over a family inheritance.
The court concluded that it lacked personal jurisdiction because the client resides in Panama, the inheritance was in Panama, the agreement containing the arbitration clause was executed in Panama and the arbitration clause provided for arbitration before a Panamanian tribunal.
When discussing the matter, Raoul explained that the Supreme Court of Panama invalidated the Jewish court's arbitral award last fall, saying the award was issued based on non-arbitrable matters and that due process violations occurred.
