Musk flexes muscle to stop Infowars’ X account sale to The Onion

In Bloomberg, White & Case partner Gregory Pesce is quoted on X's attempt to block the transfer of Alex Jones' Infowars to The Onion's parent company, Global Tetrahedron LLC.

Pesce said, "Notwithstanding all the commentary about free speech, the terms of use provide pretty broad discretion and latitude to the social media companies to control what goes on their platforms."

"It all comes down to the bible for these companies, which is their terms of use," he notes. "Does the terms of use let you transfer it and, with respect to the other stuff that the families and The Onion are buying, can you put that stuff that they’re buying—the content, the logos, etc.—can you put that on X in a new configuration after the sale's approval?"

Pesce says he believes the dispute over the Infowars account is part of a broader trend, where bankruptcy courts are assessing as part of technology-focused platforms in bankruptcies over who controls the rights to access those platforms.
